These Terms of Service are an agreement between you and Neveth LLC, doing business as Neveth Health. They cover this website, the health assessment, the patient portal, the messages you exchange with us, and everything else we provide that is not itself the practice of medicine. Read them alongside our Privacy Policy and Telehealth Consent.
1Agreeing to these terms
By using this website or any part of our service, you confirm that you have read these terms and agree to them. If you do not agree, stop using the service.
Some parts of the service come with their own additional terms — a telehealth consent form, a pharmacy notice, a subscription agreement shown at checkout. Where those apply, they sit alongside this document, and if a conflict arises about a specific point, the more specific document governs that point.
2What Neveth Health is
Neveth Health is a metabolic health clinic. We provide the technology and administrative platform that connects you with independent licensed healthcare providers, and we coordinate the supporting services around your care — laboratory testing, pharmacy fulfilment, scheduling, billing and patient support.
Neveth Health is not a pharmacy. We do not compound, manufacture, dispense or ship medication, and we do not practise medicine ourselves. Every clinical decision — whether to treat you, what to prescribe, at what dose, and whether to continue — is made by the treating provider using their own professional judgement. We do not direct or override that judgement.
3Who can use the service
To use Neveth Health you must:
- Be at least 18 years old
- Be a resident of the United States and physically present in a state where your provider is licensed at the time care is delivered
- Be legally able to enter into a binding contract
- Use the service for yourself, not on behalf of someone else, unless you are legally authorised to do so and we have agreed to it
We may ask you to verify your identity, age or location, and we or a provider may decline or suspend access if that verification is not possible.
4State Coverage
Services are available in all 50 states and Washington D.C. Medication and product availability varies based on clinical appropriateness, applicable federal and state laws, or other regulatory requirements. Not all therapies are available in all states. Availability is subject to change.
Patients start with an online questionnaire. Where state rules allow, a licensed clinician reviews it asynchronously. Where a state requires a live video or phone visit, we reach out to schedule one before anything is prescribed.
5Not for emergencies
This service is not built for urgent or life-threatening problems, and messages sent through it are not monitored around the clock. If you are having a medical emergency, call your local emergency number or go to the nearest emergency department. Do not use the assessment, the portal or any message channel to report emergency symptoms.
6Licensed clinicians and pharmacy partners
Care is provided by licensed clinicians, including nurse practitioners and MDs. OpenLoop’s Telehealth Consent identifies the medical groups involved in care. Your treating medical group is identified during your visit.
Neveth does not make prescribing decisions. Licensed pharmacies dispense medication only against an appropriate prescription.
7Telehealth consultations
Patients start with an online questionnaire. Where state rules allow, a licensed clinician reviews it asynchronously. Where a state requires a live video or phone visit, we reach out to schedule one before anything is prescribed.
Additional information, testing or in-person care may be required based on clinical judgment.
8Treatment is not guaranteed
Creating an account, completing an assessment, entering payment details or finishing checkout does not entitle you to treatment and does not create a provider–patient relationship on its own. That relationship begins only when a licensed provider reviews your information and accepts your care.
No prescription is issued and no medication is dispensed or shipped before a provider has evaluated you and written a valid prescription. If a provider decides treatment is not appropriate for you, that decision stands.
9Prescriptions and compounded medication
Some treatments offered through Neveth Health require a prescription and are dispensed only by a licensed pharmacy against a valid, patient-specific prescription.
A provider may prescribe a compounded medication where that is clinically appropriate and legally permitted. Compounded medications are not approved by the U.S. Food and Drug Administration. The FDA does not review them for safety, effectiveness or quality before they are marketed. A compounded preparation is not an approved by the FDA generic and is not automatically equivalent to a branded product.
Where this website refers to an active ingredient or a brand-name medication, it does so to identify what is being discussed. It does not mean a compounded product is approved by the FDA, generic, or therapeutically equivalent to any branded medicine.
Medication you receive may look different from any product image on this website. Follow the storage and handling instructions supplied by the pharmacy.
10Laboratory testing
Your provider may request laboratory work before starting treatment or during it. Testing is carried out by CLIA-certified laboratories, and lab panels are billed separately from treatment and consultation fees.
Some panels are a condition of continuing therapy rather than optional. If your provider requires testing and you do not complete it, treatment may be paused or discontinued. Lab results are returned to your provider and become part of your medical record.
11Information you give us
You agree that the information you provide — your identity, age, location, contact details, medical history, current medications and supplements, allergies, pregnancy status and anything else asked of you — is accurate, current and complete.
Incomplete or misleading health information can lead to unsafe treatment. If your health, medications or circumstances change while you are under care, tell your provider promptly. We may suspend or end access where information is found to be materially false.
12Your account and the portal
Neveth Health uses Bask as its patient platform. Use the Log In link to access your patient portal, or contact our support team for assistance. You are responsible for keeping your login details confidential and for what happens under your account.
Do not share your account, create one using false details, or submit another person's health information without authorisation. Tell us straight away if you think someone else has access to your account.
13Pricing and payment
Your subscription covers the provider visit and medication, if prescribed. Nothing is prescribed or shipped until a licensed clinician has reviewed your information and approved treatment. Review your billing schedule and any additional lab or shipping charges before payment.
Before checkout, patients must review and agree to the Terms and Conditions, Privacy Policy, Cancellation and Refund Policy and applicable Telehealth Consent. The subscription begins after completion of the intake form and payment for the first month; payment does not guarantee treatment.
14Subscriptions and cancellation
You may cancel your subscription at any time by contacting care@nevethhealth.com or through your patient portal, if applicable. Your request must be received at least 72 hours before your next billing date. Otherwise, the current billing cycle is charged and cancellation takes effect for the subsequent cycle. Services continue through the end of the current billing cycle.
15Refunds
The Subscription Services Cancellation and Refund Policy is incorporated into these terms. It explains the initial 72-hour refund window when no services have been received, medical disqualification, monthly subscriptions, multi-month subscriptions, and damaged or incorrect items. Review the full policy before payment.
16Shipping and delivery
Delivery estimates are estimates, not guarantees. Timing depends on provider review, pharmacy processing, ingredient availability, prescription clarification, address verification, carrier performance, weather and holidays.
Medication ships only to addresses in states where the dispensing pharmacy is authorised to send it. You are responsible for giving us a complete and accurate address and for storing and handling your medication as instructed.
17No guaranteed outcome
Neither Neveth Health nor any provider or pharmacy guarantees that you will be eligible, that treatment will be approved, that a particular medication, dose or formulation will be available, or that you will achieve any specific result.
Nothing on this website is a promise of weight loss, changed body composition, improved performance or recovery, better sleep, particular laboratory values, disease prevention or a longer life. Results vary between individuals, and every treatment carries risks, limitations and alternatives that you should discuss with your provider.
18Content on this website
Apart from messages from your own provider about your own care, everything on this site is general information and education. It is not medical advice, not a diagnosis, and not a substitute for a clinician who knows your history.
Do not delay seeking medical advice, or ignore advice you have been given, because of something you read here.
19Acceptable use
You agree not to:
- Give false, misleading or fraudulent information
- Impersonate anyone or misrepresent your identity, age, location or medical history
- Seek medication for resale, diversion, sharing with others, or any unlawful purpose
- Interfere with the security, availability or integrity of the service
- Scrape, harvest or use automated tools to access the site without our permission
- Reverse engineer the service or attempt to extract its source code or underlying logic
- Upload malicious code or anything designed to cause harm
- Break the law, infringe anyone's rights, or breach these terms
20Our intellectual property
The Neveth Health name, logo, site design, written content, photography, software and workflows belong to us or are licensed to us. You may not copy, adapt, republish or use them commercially without our written permission. Rights not expressly granted are reserved.
Third-party names and trademarks that appear on this site belong to their owners. Mentioning them does not imply any affiliation with, or endorsement by, those owners.
21Third parties we work with
Our service connects to independent organisations — healthcare providers, pharmacies, laboratories, our patient portal provider, payment processors, identity verification vendors, shipping carriers and analytics providers. Each is responsible for its own service and may have its own terms and privacy notices.
We work only with partners we believe are appropriately licensed and authorised, but including a third party here is not a guarantee about that party's availability or performance.
22Privacy
Our Privacy Policy explains what we collect and what we do with it. Your provider, your pharmacy and any laboratory involved in your care may also give you separate privacy notices, including a Notice of Privacy Practices under HIPAA where that applies.
Information you submit through this website is transmitted over an encrypted connection and protected by administrative, technical and physical safeguards.
23Disclaimers
To the fullest extent the law allows, our non-clinical services — the website, the platform, the portal and the administrative support around your care — are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability.
This section does not disclaim anything that cannot lawfully be disclaimed. In particular, it does not limit the professional duties owed to you by licensed healthcare providers or pharmacies, or your rights under consumer protection law.
24Limitation of liability
To the fullest extent the law allows, Neveth Health and its officers, employees, contractors, affiliates and non-clinical service providers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business opportunity, arising from your use of or inability to use our non-clinical services.
Nothing here limits liability for professional negligence, fraud, wilful misconduct, or anything else that cannot lawfully be limited.
25Indemnity
To the fullest extent the law allows, you agree to cover our reasonable losses, damages and legal costs if they arise from your unlawful use of the service, a material breach of these terms, your violation of someone else's rights, or information you submitted that was fraudulent or deliberately misleading.
26Suspending or ending access
You can stop using the service at any time and can ask us to close your account. We may suspend or end your access if you breach these terms, if we suspect fraud or misuse, if we are required to by law, or if continuing would be unsafe.
If access ends, your medical records are still retained for the period required by law, and any outstanding balance remains payable. Ask your provider about transferring your records to another clinician.
27Changes to these terms
We may change the service or these terms as our business, our partners or the law change. Updated terms are posted here with a new date at the top. Where the law requires it, we will give you additional notice or ask for your agreement before a material change takes effect. Continuing to use the service after a change means you accept the updated terms.
